Healthy Schools Bill Passes March 8, 2005
SB 172, which improves nutrition and mandates PE in Kentucky schools, was passed 3-8-05.
Summary of the Bill
1) Bans soft drink sales in elementary
school during the school day.
2) Allows elementary schools to sell
water, juice low-fat milks (plain
or flavored) and other beverages that
contain less than 10 grams of
sugar per serving.
3) Limits retail fast food in cafeterias
to once a week.
4) Requires the school food service
director or other person who is
responsible for meal planning to become
credentialed or certified.
5) Requires 8 hours annually of nutrition
education for school food
service directors and 2 hours for cafeteria
managers.
6) Requires an annual report on the school
nutrition and physical
activity environment.
7) Requires local school-based councils in
elementary schools (or the
school principal in cases where elementary
schools don't have a
school-based council) to develop and
implement a wellness policy that
includes daily physical activity. Allows
up to 30 minutes a day or 150
minutes of week of the physical activity to
be included as instructional time.
8) Establishes penalties for competitive
food violations.
9) Requires the KY Board of Education to
promulgate regulations that
address the nutritional content of foods
and beverages sold in school
stores, vending machines, canteens and a la
carte cafeteria sales.
